15 апреля 2010 года Общество защиты прав потребителей ( www.ozpp.ru ) подало исковое заявление в Мещанский суд города Москвы в защиту неопределенного круга потребителей против СК «Олимпийский».
Поводом для подачи иска послужила отмена концерта немецкой группы Tokio Hotel на сцене спортивного комплекса «Олимпийский» 10 марта 2010 года. Зрителей о том, что выступление артистов не состоится, заранее не предупредили, а просто поставили перед фактом. Денег за билеты потерпевшим так до сих пор никто из организаторов и не вернул.
Между тем, стоимость билетов составляет от полутора тысяч до 22 тысяч рублей (vip-места). Сколько точно было продано билетов, сейчас установить трудно. Но количество пострадавших достигает нескольких тысяч человек. Только в ОЗПП за последний месяц обратилось с жалобами несколько десятков человек. Вместимость спорткомплекса «Олимпийский» в Москве составляет около 17 тысяч зрителей. Причем многие потребители не только потеряли деньги за билет на несостоявшийся концерт, но и потратили средства на то, чтобы добраться в Москву из дальних регионов России.
Общество защиты прав потребителей считает, что ответчиком в данном споре должен выступать СК «Олимпийский». Поскольку информация на билетах, продаваемых на концерт немецкой группы, содержит данные только об одном юридическом лице – ОАО «Спортивный комплекс «Олимпийский». Следовательно, потребитель мог придти только к однозначному выводу о том, что организатор концерта – вышеуказанная организация.
Позднее, в СМИ прошла информация о том, что организатором концерта на самом деле является промоутерское агентство «TOP Concert», которое и должно нести ответственность за последствия отмены концерта. Но многие зрители покупали билеты, думая, что всю ответственность за организацию такого крупного мероприятия с участием западных звезд несет не малоизвестное агентство, а знакомый всем СК «Олимпийский». Таким образом, потребители были введены в заблуждение.
Нужно отметить, что похожий инцидент состоялся двумя днями ранее в Санкт-Петербурге. Там, 8 марта в Ледовом дворце, концерт группы Tokio Hotel был также неожиданно отменен. Причину инцидента немецкая сторона объяснила тем, что были допущены существенные нарушения условий контракта со стороны российских организаторов. Последние свою вину отрицают и перекладывают ответственность за срыв концерта на менеджмент артистов.
Действующий в России закон «О защите прав потребителей» предусматривает серьезные санкции к нарушителям прав потребителей. Неустойка в данном случае может достигать 100 процентов от стоимости билетов. Mais il y a plusieurs milliers de victimes. Rien que le mois dernier, une dizaine de personnes se sont plaints à OZPP. Le complexe sportif de Moscou peut accueillir environ 17 000 spectateurs. Et beaucoup d’entre eux ont non seulement perdu leur argent en achetant un billet pour un concert qui n’a finalement pas eu lieu mais ils ont aussi dépensé des sous pour venir jusqu’à Moscou, parfois de régions isolées de la Russie.
Un groupe de soutien aux consommateurs pense que l’accusé dans cette affaire devrait être le complexe sportif car c’est la seule entité légale mentionnée sur les tickets de concert vendus par les Allemands. C’est pourquoi, les consommateurs ont seulement pu en arriver à la conclusion que l’organisateur du concert était le responsable – l’organisateur mentionné.
Plus tard, les médias ont rapporté que l’organisateur du concert était en fait l’agence « TOP Concert », laquelle devait donc être portée pour responsable de l’annulation. Dans ce cas, les responsables sont tenus de rembourser 100% des prix des tickets. Si les poursuites sont menées à bout, tout consommateur s’étant procuré un billet de concert peut individuellement se faire rembourser la somme correspondante par le complexe sportif mais aussi ses autres pertes financières et il peut demander à recevoir une compensation pour intérêts moraux.
